Key takeaways
- Article 300 of the Labor Code requires at least one month (30 days) of written notice; count from the day HR receives your letter.
- You may resign without notice only for a just cause such as serious insult, inhuman treatment or a crime against you or your family.
- Leaving without notice and without a just cause can make you liable for damages, so ask HR to waive the balance in writing instead.
- Final pay, including pro-rated 13th month pay and unused service incentive leave, should be released within 30 days of separation; the COE within 3 days of your request.
- Always keep a copy of your resignation letter stamped “received” with the date and HR’s signature.
The three ways to use this format
| If you want to… | Choose | What you get |
|---|---|---|
| See a complete 30-day notice before writing yours | See a filled example | Maria Clara S. Dela Cruz’s resignation from Makati Business Solutions Inc., with dates and turnover lines |
| Enter your dates and print or email a clean letter today | Fill it online | A one-page letter with your last day computed, turnover, COE and final pay requests built in |
| Write it by hand or have a supervisor sign on paper | Blank, to fill by hand | A one-page form with the parts labelled and a “received by” block for HR |
Use the tabs above the form to switch between English and Tagalog, and between a 30-day notice, an immediate resignation, a simple letter and a call center version. The generator adds a receiving-copy block at the bottom so HR can sign and date your copy. Nothing you type is stored.
What a resignation letter must say
A good resignation letter is short and boring on purpose. It is a legal notice, and it will sit in your 201 file for years. HR checks four things: that you clearly resign (not “I am thinking of leaving”), the position you hold, the effective date, and your signature. Everything else is courtesy.
- The date of the letter, written in full: October 1, 2026.
- The addressee: your immediate supervisor or the HR manager, by name and title.
- A clear statement: “I am resigning from my position as Customer Service Representative.”
- The last working day: “effective October 31, 2026”, at least 30 days after HR receives the letter.
- One or two sentences of thanks. No complaints; those belong in an exit interview or a separate letter.
- A turnover commitment: what you will hand over and to whom.
- A request for your certificate of employment and the release of your final pay.
- Your signature over your printed name in capitals, and a “Received by” line for HR.

Immediate resignation letter: when you can leave without 30 days’ notice
An immediate resignation letter ends your employment on the day you submit it, or within a few days. The Labor Code allows this only for just causes attributable to the employer: a serious insult by the employer or its representative on your honour and person; inhuman and unbearable treatment; a crime or offence committed by the employer or its representative against you or your immediate family; and other causes analogous to these. If one of these applies, say so plainly and briefly in the letter, with dates, and keep your evidence (messages, incident reports, medical records) somewhere outside the office.
Here is the honest part. Wanting to start a new job next week, burnout, or a better offer is not a just cause under Article 300. If you leave without notice and without a just cause, the employer may hold you liable for damages it can prove it suffered. In practice, many employers simply waive the remaining notice period, especially for rank-and-file staff whose work can be covered. The safe route is to submit a normal 30-day letter and ask in writing for an earlier release date. If HR agrees, get the approval in writing or by email.
| Situation | Notice required? | Practical risk |
|---|---|---|
| Just cause under Art. 300 (insult, abuse, crime against you) | No | Low, if you can document the cause |
| Employer agrees in writing to a shorter notice | Waived | Low |
| Health or family emergency, employer informed | Yes, unless waived | Usually settled by agreement; ask for a waiver |
| You simply stop reporting (AWOL) | Yes | Possible damages claim, delayed clearance, AWOL noted in records |
Immediate resignation: what usually happens
Short sample: immediate resignation letter
Dear Mr. Reyes: I am resigning from my position as Customer Service Representative effective immediately, today, October 23, 2026, under Article 300 of the Labor Code. On October 20, 2026, my team leader shouted insults at me in front of the floor and threatened me, as I reported to HR in writing on the same day. I no longer feel safe reporting to work. I will return my company ID, headset and laptop to HR on October 26, 2026, and I request my Certificate of Employment and the release of my final pay. Respectfully yours, MARIA CLARA S. DELA CRUZ
Simple resignation letter and resignation letter due to personal reasons
You do not have to explain why you are leaving. A simple resignation letter of three or four sentences is complete and legally sufficient. If you want to give a reason, “personal reasons”, “family reasons” or “to pursue another opportunity” is enough; you are not required to disclose a health condition, a pregnancy or your new employer.
Short sample: simple resignation letter
Dear Mr. Reyes: Please accept this letter as my formal resignation from my position as Customer Service Representative, effective October 31, 2026. Thank you for the opportunity to work with Makati Business Solutions Inc. I will make sure my work is properly turned over before my last day. I also request my Certificate of Employment and the release of my final pay. Respectfully yours, MARIA CLARA S. DELA CRUZ
Short sample: resignation letter due to personal reasons
Dear Mr. Reyes: I am writing to formally resign from my position as Customer Service Representative, effective October 31, 2026, for personal reasons. I need to relocate to Lucena City to care for a family member. I have valued my years with the company and the guidance of my team. Over the next 30 days I will document my processes and train my replacement. I request my Certificate of Employment and the release of my final pay. Respectfully yours, MARIA CLARA S. DELA CRUZ
Resignation letter for call center (BPO) agents
BPO resignations follow the same 30-day rule, but the clearance list is longer and the account, not HR, often controls your release. Address the letter to your team leader or operations manager and copy HR, because many sites require the team leader to endorse it in the HR system. Expect the letter to be logged in a ticketing tool; take a screenshot of the submitted ticket with its date.
- Name your account or line of business and your employee ID in the first paragraph.
- Offer an account turnover: knowledge-base notes, open escalations, callbacks scheduled after your last day.
- List company property to return: ID and access card, headset, laptop or desktop peripherals, locker key, and any tokens for client systems.
- Ask how your last schedule will be handled if you are on a rotating shift or rest days fall on your final week.
- Check whether your contract has a training bond. Read the clause before you resign; deductions from final pay need a valid basis and, for property, your written authorisation.
Resignation letter in Tagalog (Filipino): sample
A resignation letter in Filipino is just as valid as one in English. Keep the same parts: date, addressee, clear statement, last day, turnover, and request for COE and final pay. Address your supervisor as “Ginoo” or “Ginang”, and close with “Lubos na gumagalang,”. Choose the Tagalog tab in the generator for the full template.

How to fill it, section by section
Your details
Write your full name as it appears in company records, your position title exactly as stated in your appointment or latest promotion memo, your department or account, and your employee ID. HR matches these to your 201 file. If you were promoted, use the current title; your COE will list the history.
Add a personal email and mobile number in the letter or below your signature. After your last day, you lose access to your company email, and HR will need to reach you about clearance, your final pay release and your BIR Form 2316.
Employer and addressee
Address the letter to the person your company handbook names for resignations, usually your immediate supervisor, with HR copied. If the handbook is silent, address the HR manager. Write the company’s registered name (Makati Business Solutions Inc., not just “MBS”) and office address.
Delivery matters more than the addressee. Hand it over in person and ask for a receiving copy signed and dated, or send it by email and keep the sent email, or send it by registered mail and keep the registry receipt. Your 30 days start from receipt, so proof of receipt is your proof of notice.
Notice and last day
State the effective date as a calendar date, not “30 days from today”. Count 30 calendar days from the date HR receives the letter. If that date falls on a rest day or holiday, name the last working day before it as well, so HR records both dates the same way you do.
- Letter received by HR
- October 23, 2026 (Friday)
- Add 30 calendar days
- October 23 + 8 days = October 31; + 22 days = November 22
- Effective date
- November 22, 2026 (Sunday, a rest day)
- Last working day you can name
- Friday, November 20, 2026
Write: “My last working day will be November 20, 2026, and my resignation is effective November 22, 2026.”
Your contract or company policy may require a longer notice for managers. A contract cannot shorten your protection below the law, but a longer agreed notice for senior positions is common; check your contract before you date the letter.
Reason and turnover
The reason is optional. One neutral phrase is enough. Do not use the letter to list grievances unless you are resigning for a just cause, where a short factual statement is needed.
The turnover paragraph does more for your final pay than the thank-you. Name the work you will hand over (open files, client accounts, passwords to shared tools, petty cash), the person receiving it, and the property you will return. Clearance sign-offs are tied to these items, and a vague “I will turn over my work” leaves room for a department to hold your clearance.
Final pay and COE
End with a request for two things: your certificate of employment and the release of your final pay. Mention the components so nothing is forgotten: unpaid salary up to your last day, pro-rated 13th month pay, cash conversion of unused service incentive leave (and other convertible leave under company policy), and your tax refund if any. Citing DOLE Labor Advisory No. 06, s. 2020 is polite and tells HR you know the timelines.
If you want the COE early, for a new employer’s onboarding, request it separately with the COE request letter; it is due within three days of your request even before your clearance is done. Estimate what you should receive with the final pay calculator.
Eight resignation mistakes that delay your final pay
| The mistake | Why it matters | Do this instead |
|---|---|---|
| No receiving copy | You cannot prove when the 30 days started | Get a stamped, signed and dated copy or keep the sent email |
| “Effective immediately” without a just cause | Exposes you to a damages claim and an AWOL record | Give 30 days and ask HR to waive part of it in writing |
| “30 days from today” instead of a date | HR and you may count differently | Write the exact calendar date |
| Complaints and accusations in the letter | Stays in your 201 file; may be used against you | Keep it neutral; raise issues in the exit interview or a separate letter |
| Resigning by text or chat only | Not a clear written notice | Send a signed letter or a formal email to HR |
| Not returning property before the last day | Clearance stalls; value may be deducted with your authorisation | List items in the letter and get a return receipt |
| Forgetting to ask for the COE | Your new employer may need it on day one | Request it in the letter; it is due within 3 days |
| Signing a quitclaim without checking the figures | You may waive amounts still owed to you | Compare the computation with the final pay calculator first |
Resignation letter vs acceptance letter vs clearance vs COE vs quitclaim
Leaving a job produces a small bundle of documents. Each does a different job, and only the first is yours to write.
| Document | Who issues it | What it does |
|---|---|---|
| Resignation letter | You | Gives written notice and sets your last day |
| Acceptance of resignation | Employer | Confirms the effective date in writing; useful proof of when you left |
| Clearance form | Employer (each department signs) | Confirms property returned and accountabilities settled |
| Certificate of employment | Employer | States your dates and position; due within 3 days of request |
| Final pay computation and quitclaim | Employer | Lists what you receive; you sign upon payment |
| BIR Form 2316 | Employer | Certificate of compensation and taxes withheld, needed by your next employer |
If the employer does not pay on time, the next document is yours again: a demand letter for final pay, and if that fails, a SEnA request for assistance at DOLE.
Article 300 of the Labor Code: the 30-day notice rule
Article 300 (it carried a different number before DOLE’s 2015 renumbering) governs termination by the employee. An employee may end the employment without just cause by serving a written notice on the employer at least one month in advance. The employer upon whom no such notice was served may hold the employee liable for damages. An employee may end the employment without notice for any of the just causes listed in the article. For the short version, see resignation law at a glance on the employment hub.
| Rule | What it means for you |
|---|---|
| Written notice at least one month in advance | Give your letter at least 30 days before your last day |
| No notice served → liability for damages | The employer must prove actual damage; many waive instead |
| Just cause (a): serious insult on your honour and person | Immediate resignation allowed |
| Just cause (b): inhuman and unbearable treatment | Immediate resignation allowed |
| Just cause (c): crime or offence against you or your immediate family | Immediate resignation allowed |
| Just cause (d): analogous causes | Similar serious causes; get advice before relying on this |

Rendering your 30 days: what it means and how to handle it
“Rendering” is everyday office speech for working through your notice period. You work your normal schedule, receive your normal pay, and hand over your work. You can use approved leave credits during the period if your company allows it, which some employees do to shorten the days they physically report; ask HR in writing, because some companies freeze leave during rendering.
- If your new employer wants you earlier, ask your current HR for a shorter rendering period. Put the request and the answer in writing.
- If you get sick during rendering, file sick leave as usual; the effective date does not move unless both sides agree.
- Stopping work mid-rendering without agreement is treated like resigning without notice.
- Probationary employees follow the same rule unless their contract provides otherwise.
Can my employer refuse my resignation?
An employer cannot force you to keep working. Article 300 gives the employee the right to end the employment by serving 30 days’ written notice; the article itself does not require the employer’s approval. What the employer can do is ask you to complete the notice period and the clearance process, and claim damages if you leave without notice and without a just cause. An HR “acceptance” letter is still useful, because it fixes the effective date in writing.
Watch for the opposite problem. If a supervisor pressures you to sign a pre-written resignation letter, refuse and write down what happened. A resignation must be voluntary; a forced resignation can be challenged as illegal dismissal through SEnA at DOLE. Have a lawyer, PAO or the DOLE desk officer review your case before filing.
Final pay, pro-rated 13th month and COE after you resign
DOLE Labor Advisory No. 06, s. 2020 sets the timelines. Final pay must be released within 30 days from the date of separation, unless a more favourable company policy or agreement applies. The certificate of employment must be issued within 3 days from your request. Final pay covers unpaid salary, the cash conversion of unused service incentive leave, pro-rated 13th month pay, separation or retirement pay if due, your tax refund, and other benefits under your contract or CBA.
Resignation alone does not entitle you to separation pay; the Labor Code grants it for authorised causes such as redundancy or retrenchment, and some companies grant it by policy or CBA. Your 13th month pay is pro-rated: one-twelfth of the total basic salary you earned from January 1 to your last day. Service incentive leave is 5 days a year after at least one year of service, and unused SIL converts to cash.
- Monthly basic salary
- ₱25,000
- Resignation effective
- October 31, 2026 (letter received October 1, 2026)
- Basic salary earned January 1 to October 31
- ₱25,000 × 10 months = ₱250,000
- Pro-rated 13th month pay
- ₱250,000 ÷ 12 = ₱20,833.33
- COE requested in the letter on October 1
- Due by October 4, 2026
- Final pay deadline
- October 31, 2026 + 30 days = November 30, 2026
Maria’s final pay should include ₱20,833.33 in pro-rated 13th month pay, plus unpaid salary, unused SIL conversion and any tax refund, released by November 30, 2026.
Work out the rest of your figures with the 13th month pay calculator and the final pay calculator. The 13th month and other benefits are tax-exempt up to ₱90,000 for the year.
Legal basis: DOLE Labor Advisory No. 06, s. 2020 (final pay within 30 days; COE within 3 days); PD 851 and its Revised Guidelines (13th month pay, pro-rated for separated employees); Labor Code Art. 95 (service incentive leave).

The clearance process after resignation
Clearance is the company’s internal check that you have returned property and settled accountabilities before final pay is released. It is not in the Labor Code, but it is standard, and Labor Advisory 06-20 allows final pay to follow company policy as long as the 30-day timeline is met or a more favourable policy applies.
- 1
Get the clearance form early
Ask HR for it as soon as your resignation is received, not on your last day.
- 2
Return property with receipts
ID, laptop, headset, tools, uniforms, keys. Ask each custodian to sign the form or a return slip.
- 3
Settle cash accountabilities
Liquidate cash advances and petty cash. Salary loans and SSS or Pag-IBIG loans are usually deducted from final pay; ask for the computation.
- 4
Collect department sign-offs
IT, finance, admin, your supervisor. If one department sits on it, email HR with the date you submitted.
- 5
Attend the exit interview
This is the place for feedback. Keep it factual.
- 6
Review and sign the final pay computation
Check each line before signing a quitclaim. If the 30 days pass with nothing, send a demand letter.

Frequently asked questions
+How many days' notice do I need to give when I resign in the Philippines?
At least one month, or 30 days, of written notice under Article 300 of the Labor Code. Count from the day your employer receives your letter, and write the exact effective date. Your contract may require more for senior roles. You may resign without notice only for a just cause such as serious insult, inhuman treatment or a crime against you or your family. Your employer may also waive part of the notice.
+Can I resign immediately without rendering 30 days?
Only if you have a just cause under Article 300, such as a serious insult on your honour, inhuman and unbearable treatment, or a crime committed against you or your immediate family by the employer or its representative, or if your employer agrees to waive the notice. Leaving without either can make you liable for damages the employer proves. The safer route is a 30-day letter with a written request for an earlier release.
+What is a simple resignation letter sample?
Three or four sentences are enough: “Please accept this letter as my formal resignation from my position as Customer Service Representative, effective October 31, 2026. Thank you for the opportunity to work with the company. I will turn over my work before my last day. I request my Certificate of Employment and the release of my final pay.” Sign it over your printed name and get a receiving copy.
+How do I write a resignation letter due to personal reasons?
State that you are resigning for personal reasons, give your position and exact last day at least 30 days after HR receives the letter, thank your employer briefly, and offer to turn over your work. You do not have to explain further or disclose health, family or pregnancy details. If you want to add context, one neutral sentence such as relocating to care for a family member is enough.
+Can my employer refuse to accept my resignation?
Your employer cannot force you to keep working. Article 300 lets you end the employment by serving 30 days’ written notice, and the article does not require the employer’s approval. The employer can require you to complete the notice period and clearance, and may claim damages if you leave without notice or just cause. Keep a stamped receiving copy as proof you gave notice.
+Do I still get my 13th month pay if I resign?
Yes. A resigned employee receives pro-rated 13th month pay with the final pay: one-twelfth of the total basic salary earned from January 1 to the last day. For example, an employee earning ₱25,000 a month who resigns effective October 31 earned ₱250,000 in basic salary, so the pro-rated 13th month pay is ₱20,833.33. Overtime, allowances and holiday pay are not included in the base.
+When will I receive my final pay after resigning?
DOLE Labor Advisory No. 06, s. 2020 requires final pay to be released within 30 days from the date of separation, unless a more favourable company policy applies. If your last day is October 31, 2026, the deadline is November 30, 2026. If it passes, send a written demand, then file a SEnA request for assistance at DOLE. The certificate of employment is due within 3 days of your request.
+Can I write my resignation letter in Tagalog?
Yes. A resignation letter in Filipino is as valid as one in English, as long as it clearly states that you are resigning, your position and your effective date. Address your supervisor as Ginoo or Ginang, use “po” naturally, include your turnover and your request for COE and final pay, and close with “Lubos na gumagalang,” above your signature and printed name.
+What should a call center agent include in a resignation letter?
Your account or line of business, employee ID, position and exact last day at least 30 days ahead; an account turnover offer covering open escalations and callbacks; and a list of property to return such as ID, access card, headset and laptop. Address it to your team leader and copy HR, and save a screenshot if the letter is submitted through a ticketing system. Check any training bond clause first.
+Is resignation by email or text message valid?
A formal email to your supervisor and HR with your letter attached is generally treated as written notice, and the sent email proves the date. A text or chat message alone is risky because it may not be seen as a clear, formal notice. Follow up with a signed letter and ask for a receiving copy. Your 30 days are counted from the date the employer receives your notice.
